These Terms of Service ("Terms") govern your access to and use of the mobile applications, websites, and related services (collectively, the "Services") provided by Kinetic Engineering LLC ("we", "our", or "us"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Services.
By downloading, installing, or using any of our Services, you confirm that you are at least 13 years of age (or the minimum age of digital consent in your jurisdiction) and that you have the legal capacity to enter into these Terms. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal or internal business purposes. This license does not allow you to resell, redistribute, or commercially exploit the Services except as expressly permitted by us.

You retain ownership of any content you create, upload, or store using the Services ("User Content"). You are solely responsible for your User Content and the consequences of sharing it. By using the Services, you grant us a limited license to process your User Content only as necessary to provide and improve the Services.
The Services, including all software, text, graphics, logos, and other materials, are owned by or licensed to Kinetic Engineering LLC and are protected by intellectual property laws. Except for the rights expressly granted to you in these Terms, we reserve all rights, title, and interest in and to the Services.
Certain Services may be offered for a fee or on a subscription basis. Where applicable, prices and payment terms will be presented to you before purchase. Subscriptions purchased through a third-party app store are subject to that store's terms, and any cancellations or refunds are handled according to the store's policies.
The Services may contain links to or integrations with third-party services that we do not control. We are not responsible for the content, policies, or practices of any third-party services, and your use of them is at your own risk and subject to their terms.
The Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.
To the maximum extent permitted by law, Kinetic Engineering LLC and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Services. Our total liability for any claim arising out of these Terms or the Services shall not exceed the amount you paid us, if any, in the twelve months preceding the claim.
You agree to indemnify and hold harmless Kinetic Engineering LLC and its affiliates from any claims, damages, liabilities, and expenses arising out of your use of the Services, your User Content, or your violation of these Terms.
We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms or if we discontinue the Services. Upon termination, the rights granted to you under these Terms will cease, and you must stop using the Services.
These Terms are governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in California.
We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on this page with a revised effective date. Your continued use of the Services after any changes constitutes your acceptance of the updated Terms.
